Terms of service

The rules for using Kotii.

Written by humans, not lawyers pretending to be humans. If anything is unclear, email the team and we'll explain it in plain English.

Agreement

By creating a Kotii account, starting a trial, or using the Kotii product in any way, you agree to these terms. If you don't agree, don't use Kotii. Simple as that.

Kotii is operated by the Kotii team out of British Columbia, Canada. Throughout this document, “we,” “us,” and “the Kotii team” mean the same thing. “You” means the person using Kotii — either directly as a licensed real estate agent or as a collaborator (assistant, team member) an agent has added to their account.

Who can use Kotii

Kotii is built for licensed real estate agents and the assistants they designate. To create an account, you must:

  • Be at least 18 years old.
  • Hold a valid real estate license in the jurisdiction where you practice, OR be an assistant or team member working under a licensed agent who has invited you to their account.
  • Have the legal authority to accept these terms on your own behalf and on behalf of any organization you're representing.

If your brokerage has rules about which tools you can use or how client data must be handled, those rules come first — not these terms. It's your job to make sure Kotii fits within your brokerage's compliance requirements.

Acceptable use

You agree not to:

  • Use Kotii to send spam, harass anyone, or otherwise violate applicable law or your real estate board's code of conduct.
  • Misrepresent a property, a price, a neighbourhood, or yourself. Kotii drafts content — you're the one who decides whether to send it. Responsibility for what goes out in your name stays with you.
  • Use Kotii to send client-facing messages that could reasonably be interpreted as legal, financial, tax, or investment advice. Kotii is not your lawyer.
  • Upload data you don't have the right to upload, including client data you haven't been authorized to process.
  • Attempt to scrape, reverse-engineer, or resell Kotii's output in bulk.
  • Use Kotii in ways that violate fair housing laws, the Competition Act, or any other applicable consumer-protection regulation.
  • Share your account credentials with people who aren't authorized to use your account. If your assistant needs access, add them as a collaborator from the dashboard — at no extra cost.

The impersonation boundary

This is a core product commitment and a core contractual one. Kotii never impersonates you to your clients without your control. Here's the exact boundary, same as what's on the questions page:

For anything client-facing — texts, emails, DMs — Kotii drafts a response and puts it in your approval queue. You read it, edit it if you want, and hit send. The message goes out from your number, in your voice, because you actually sent it. For time-sensitive situations like “I'm running 10 minutes late” or “yes, 2pm works,” you can give Kotii permission to auto-send specific categories of short responses. Everything else waits for you. This is a product decision, not a limitation — agents who cross this line lose client trust and we're not going to help them do that.

You may not configure Kotii to send client-facing messages under false pretenses or in ways that lead your clients to believe they're communicating directly with you when they're not. Violating this boundary is grounds for account suspension.

Account suspension and termination

We may suspend or terminate your account if:

  • You violate the acceptable use rules or the impersonation boundary above.
  • A payment fails and you don't resolve it within 14 days of notice.
  • You use Kotii for illegal purposes or in ways that create substantive legal risk for the team or other customers.
  • You request it yourself by deleting your account from the dashboard or by emailing hello@kotii.live.

When an account is terminated, we delete your data per the retention policy in our Privacy Policy (within 30 days). You can always export everything before you leave.

Billing

Kotii is priced in US dollars. Pricing for launch is being finalized — final plan tiers and amounts will be published before any account is charged. Current tiers:

  • Solo. For individual agents. All four Kotii roles included. Up to 250 active clients.
  • Pro. For agents with 100+ active clients. Unlimited clients and additional capabilities.
  • Brokerage — contact us. Custom pricing for teams.

Plans are month-to-month and can be upgraded, downgraded, or canceled at any time from your billing dashboard.

30-day refund. If you pay for a month of Kotii and decide within 30 days that it wasn't for you, email hello@kotii.live and we'll refund you in full, no questions. After day 30, subscriptions are non-refundable but you can cancel anytime to prevent future charges.

We may change prices with at least 30 days' notice. If we do, you can cancel before the new price takes effect and nothing changes for your current billing cycle.

Your content and your book

You own everything you put into Kotii — client profiles, conversations, notes, documents, all of it. You grant Kotii a limited license to process that content solely to provide the product to you. That license ends when your account ends.

We do not train AI models on your client data. We do not sell your data. We do not share it with other Kotii users. See the Privacy Policy for the full handling details.

Service availability

We work to keep Kotii available and reliable, but we don't guarantee 100% uptime. Occasional maintenance, outages at our infrastructure providers, or MLS feed problems may interrupt service. We'll communicate proactively when we know about planned maintenance and post status updates when things break.

If Kotii is down for an extended period and that materially affects your use of the product, email us and we'll credit your account fairly.

Disclaimers and limitation of liability

Kotii is provided “as is” and “as available.” We don't make warranties beyond what applicable law requires. Specifically:

  • Kotii helps you work. Kotii does not replace your professional judgment as a licensed agent. Every client-facing decision is yours.
  • Kotii generates content using AI models, which can occasionally produce mistakes or outdated information. The draft-and-review workflow exists so you catch these before they reach clients.
  • Market data, comps, and neighbourhood intelligence come from third-party sources (MLS boards, public records, etc.). We work to keep these accurate but don't guarantee they reflect real-time reality.

To the maximum extent permitted by applicable law, the Kotii team's total liability to you for any claim arising from or related to these terms or your use of Kotii is limited to the amount you paid us in the 12 months before the claim arose. We are not liable for indirect, incidental, special, consequential, or punitive damages (lost profits, lost deals, lost data beyond what retention policy covers, etc.), even if we knew such damages were possible.

Nothing in this section limits liability for things that can't be limited under applicable law.

Indemnification

You agree to indemnify and hold harmless the Kotii team from claims arising out of (a) your use of Kotii in violation of these terms, (b) content you upload to Kotii that you didn't have the right to upload, and (c) messages Kotii drafts and you approve and send that violate applicable law or a third party's rights.

Changes to Kotii

We ship updates to Kotii all the time. Most of them make the product better at no extra cost. Occasionally a feature gets deprecated or replaced — when that affects you, we'll tell you via email with enough lead time to adjust.

Changes to these terms

If we make material changes to these terms, we'll update the “Last updated” date at the top of this page and email active customers at least 30 days before the changes take effect. Continued use of Kotii after that point means you accept the updated terms. Minor cleanups and clarifications happen without notification.

Governing law and disputes

These terms are governed by the laws of the Province of British Columbia and the laws of Canada applicable there, without regard to conflict-of-law principles.

Any dispute arising out of these terms or your use of Kotii will be resolved in the courts of British Columbia, and you and we both agree to submit to the exclusive jurisdiction of those courts. Before filing anything, email hello@kotii.live and we'll try to sort it out directly — most things can be handled with a conversation.
